Terms of Service

Prompten is currently in beta and under active development. Features may change, break, or be removed without notice. The service may be unavailable for extended periods, lose data, or behave unexpectedly. Any subscription purchased during this phase is non-refundable and you acknowledge that you are paying for an in-development product. By subscribing or using Prompten you agree that we are not liable for any losses, damages, or interruptions arising out of beta-phase issues. See Section 9 below for the full limitation of liability.
By signing up for a Prompten account or using the Chrome extension, you agree to these terms. If you don't agree, don't use the service. We've tried to keep this short and readable; the Privacy Policy covers the data side separately.
1. The service
Prompten is a tool that rewrites your prompts so AI assistants give you better answers. We provide a website (account management, billing) and a Chrome extension that calls our API. The product is “as-is”: features may change, improve, or be deprecated as the product evolves.
Prompten is owned and operated by Banana Holdings LLC, a US-registered limited liability company. References to “we”, “us”, “our”, or “Prompten” in these terms refer to Banana Holdings LLC. By accepting these terms you are entering a contract with Banana Holdings LLC.
2. Your account
You're responsible for keeping your account credentials secure and for all activity under your account. One person, one account; sharing accounts with multiple users isn't allowed (use multiple accounts instead — the Free tier is generous).
You must be at least 13 years old to use Prompten. If you're using it on behalf of a company, you confirm you have the authority to bind that company to these terms.
3. Acceptable use
Don't use Prompten to:
- break the law, infringe IP, or violate someone's privacy;
- generate content that targets, harasses, or endangers people;
- generate spam, malware, or material designed to deceive;
- circumvent rate limits, the Free-tier cap, or any other metering mechanism — including by running multiple accounts to dodge billing;
- resell our API or wrap it in another product without written permission;
- scrape or train other models on the rewriting outputs.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Plans and billing
The Free tier includes a fixed number of enhances per UTC day (currently 5). The counter resets at midnight UTC. Pro plans (Monthly or Annual) remove that cap. Pricing is shown on the pricing section and may change with notice.
Subscriptions auto-renew at the end of each billing period unless canceled. You can cancel any time from the account page; access continues through the end of the current period. Stripe handles all card payments; we don't see your card details.
Refunds. We don't typically offer refunds for subscription periods that have already started — the monthly plan exists so you can try one cycle at low risk. If something is genuinely broken on our side, email us and we'll make it right.
5. Your prompts and outputs
You retain ownership of the prompts you send and the enhanced outputs we return. You're responsible for the legality of the content you put in and what you do with the content you get out. We don't claim any rights over either.
AI rewriting is probabilistic — outputs may be inaccurate, biased, or unsuitable for your purpose. Don't rely on Prompten for medical, legal, financial, or safety-critical decisions without verifying.
6. Our IP
Prompten's code, brand, and the prompt-engineering system itself are ours. You don't get any rights to them beyond what these terms grant. Don't copy or reverse-engineer the service.
7. Service availability
We aim for high uptime but don't guarantee it. The service depends on third-party providers (LLM, hosting, payments, authentication) — outages or rate limits at any of them can affect us. We may take the service down for maintenance with reasonable notice.
8. No warranty
The service is provided “as-is” and “as-available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow these disclaimers; in that case they apply to the extent permitted by law.
9. Limitation of liability
To the maximum extent allowed by law, Prompten's aggregate liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — even if we knew they were possible.
Beta phase: During the current beta development phase, the limitation above applies in full and you specifically agree that Prompten is not liable for any loss arising from beta-status defects, data loss, outages, breaking changes, feature removals, or the service being discontinued. Subscriptions purchased during this phase are non-refundable. You are paying for early access to a product under active development — you accept this risk by subscribing.
10. Termination
You can stop using Prompten at any time and delete your account from the account page. We can suspend or terminate accounts that violate these terms or for legal/operational reasons; if we do, we'll refund the unused portion of any prepaid Pro period unless the termination is for abuse.
11. Changes to these terms
We may update these terms as the product evolves. Material changes will be communicated via email or a site banner before they take effect. Continued use after the effective date means you accept the changes.
12. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction.
